When someone uses the services of a realtor in Greece, this implies that the broker works for and mediates between the two parties - seller and buyer - means he represents both parties simultaneously and equally.
Accordingly, the broker - so we do - has the right to request a commission from both parties if a conclusion of the contract for the purchase of a property as a result of broker mediation is successful. The fee is determined in a broker's order or a brokerage agreement. The content of a brokerage contract is always subject to private autonomy.
Article 703 ff ZGB (GR) regulates the due date of the brokerage fee. If an individual agreement is missing, a brokerage fee (2% of the purchase price specified in the deed of purchase) will be payable if the conclusion of the contract for the purchase of the property as a result of broker mediation is successful.
However, the broker can assert the expenses incurred - regardless of the success of the brokerage - insofar as this has demonstrably been agreed.
